These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Webority Technologies Private Limited, a company incorporated under the laws of India ("Company", "we", "us", or "our"), governing your access to and use of the Build Studio platform available at contact@webority.com and all associated services, applications, and tools (collectively, the "Platform").

1. Acceptance of Terms

By accessing, registering for, or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Platform on behalf of an organisation, you represent and warrant that you have the authority to bind that organisation to these Terms. If you do not agree to these Terms, you must not access or use the Platform.

2. Eligibility

You must be at least 18 years of age to use the Platform. By using the Platform, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement. In accordance with the Digital Personal Data Protection Act, 2023 (DPDP Act), we do not knowingly allow individuals under 18 years of age to create accounts or use the Platform.

3. Description of Service

Build Studio is a mobile application testing, analysis, and distribution platform that provides:

• Automated security scanning and vulnerability analysis for mobile applications (iOS and Android)
• Build quality insights, performance metrics, and actionable recommendations
• Secure build distribution and sharing with configurable expiry and access controls
• In-app feedback collection tools for testers and stakeholders
• Team collaboration features for developers, QA teams, and product owners
• CI/CD integration for automated build workflows
• Version management with history tracking and rollback capabilities

4. User Accounts

To access certain features of the Platform, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information to keep it accurate
• Maintain the confidentiality and security of your account credentials
• Notify us immediately at contact@webority.com of any unauthorised access or security breach
• Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that contain inaccurate information, are inactive for an extended period, or are in violation of these Terms.

5. Acceptable Use

You agree to use the Platform only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Upload, distribute, or share any malicious code, malware, spyware, viruses, or harmful software
• Upload or distribute pirated, counterfeit, or unlicensed software
• Violate any applicable local, state, national, or international law or regulation
• Infringe upon the intellectual property rights, privacy rights, or other rights of any third party
• Attempt to gain unauthorised access to our systems, servers, networks, or other users' accounts
• Reverse engineer, decompile, or disassemble any part of the Platform
• Use automated means (bots, scrapers, crawlers) to access the Platform without our written consent
• Overwhelm, disrupt, or impair the Platform's infrastructure through excessive requests or denial-of-service attacks
• Use the Platform to store or transmit content that is defamatory, obscene, or otherwise objectionable
• Resell, sublicence, or redistribute the Platform or any part thereof without our prior written consent

6. Content Ownership and Intellectual Property

Your Content

You retain all ownership rights to the builds, applications, and content you upload to the Platform ("Your Content"). By uploading Your Content, you grant us a limited, non-exclusive, royalty-free licence to process, analyse, store, and display Your Content solely for the purpose of providing the Platform services to you. This licence terminates when you delete Your Content or close your account.

Our Content

The Platform, including its software, design, logos, trademarks, analysis algorithms, documentation, and all other proprietary materials (collectively, "Our Content"), is owned by Webority Technologies Private Limited and is protected under applicable intellectual property laws, including the Copyright Act, 1957, the Trade Marks Act, 1999, and the Patents Act, 1970 of India, as well as international intellectual property treaties.

You may not copy, modify, distribute, sell, or create derivative works of Our Content without our express written permission.

7. Privacy and Data Protection

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, store, and protect your personal data. We comply with the Digital Personal Data Protection Act, 2023 (DPDP Act), the Information Technology Act, 2000 (IT Act), and the General Data Protection Regulation (GDPR) where applicable. By using the Platform, you consent to the collection and processing of your data as described in our Privacy Policy.

8. Shared Builds and Distribution

When you use the Platform's build distribution features:

• Shared build links expire automatically after the configured expiry period (default: 7 days)
• You may set passwords and access restrictions for additional security
• You are solely responsible for determining who you share build links with and ensuring that distribution complies with applicable laws and any third-party agreements
• Download activity may be tracked for analytics and security monitoring purposes
• We reserve the right to remove shared content that violates these Terms or applicable law
• You must not use the distribution features to share builds that contain malware, infringe intellectual property, or violate export control regulations

9. Subscription Plans, Fees, and Payment

The Platform offers both free and paid subscription plans. If you subscribe to a paid plan:

• Fees are charged in advance on a monthly or annual basis, as selected by you
• All fees are exclusive of applicable taxes (including GST in India), which will be added where required by law
• Payment is processed securely through Stripe; we do not store your full payment card details
• You authorise recurring charges to your payment method for the duration of your subscription
• We may change subscription pricing with at least 30 days' prior written notice; changes will apply from your next billing cycle
• Failure to pay may result in suspension or downgrade of your account

Refund Policy

Subscription fees are generally non-refundable. However, if you believe you are entitled to a refund due to a service deficiency or billing error, you may contact us at contact@webority.com within 7 days of the charge. We will review each request on a case-by-case basis and process eligible refunds in accordance with applicable consumer protection laws, including the Consumer Protection Act, 2019 of India. Refunds, if approved, will be processed to the original payment method within 10 business days.

10. Service Availability

While we strive for high availability, we do not guarantee uninterrupted or error-free operation of the Platform. We may:

• Perform scheduled maintenance with reasonable advance notice where practicable
• Perform emergency maintenance without prior notice to address critical issues
• Modify, update, or discontinue features or services at our discretion
• Impose reasonable limits on storage, upload sizes, API calls, or other usage parameters

11. Disclaimer of Warranties

The platform is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by applicable law, we disclaim all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy. We do not warrant that the platform will be uninterrupted, secure, or error-free, that defects will be corrected, or that the results of any build analysis will be accurate or complete. The security scan results and recommendations provided by the platform are informational only and do not constitute a guarantee of security or compliance.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Webority Technologies Private Limited and its directors, officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, goodwill, or business opportunities, whether arising from contract, tort (including negligence), strict liability, or otherwise, even if advised of the possibility of such damages. In no event shall our total aggregate liability for all claims arising out of or related to these terms or your use of the platform exceed the amount paid by you to us in the twelve (12) months immediately preceding the event giving rise to the claim, or INR 10,000 (Indian Rupees ten thousand), whichever is greater.

13. Indemnification

You agree to indemnify, defend, and hold harmless Webority Technologies Private Limited, its directors, officers, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Platform; (b) Your Content or any builds you upload or distribute through the Platform; (c) your violation of these Terms; (d) your violation of any applicable law or regulation; or (e) your infringement of any third-party rights, including intellectual property rights.

14. Termination

Either party may terminate this agreement as follows:

• By You: You may cancel your account at any time through your account settings or by contacting us at contact@webority.com. Cancellation will take effect at the end of your current billing period.
• By Us: We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent or illegal activity, or if required by law. We may also terminate your account with 30 days' written notice for any reason.

Upon termination: (a) your right to access the Platform ceases immediately; (b) we will retain your data for 90 days to allow for data export, after which it will be permanently deleted; (c) any outstanding fees remain payable; and (d) provisions that by their nature should survive termination (including Sections 6, 11, 12, 13, 16, and 17) will continue to apply.

15. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting a notice on the Platform, updating the "Last Updated" date above, or sending an email to your registered email address at least 15 days before the changes take effect. Your continued use of the Platform after the effective date of any modifications constitutes your acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the Platform and close your account.

16. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. The courts located in India shall have exclusive jurisdiction over any disputes arising out of or relating to these Terms or your use of the Platform, subject to the arbitration provisions in Section 17 below.

17. Dispute Resolution and Arbitration

In the event of any dispute, controversy, or claim arising out of or relating to these Terms or the Platform:

• Informal Resolution: The parties shall first attempt to resolve the dispute through good-faith negotiation for a period of 30 days from the date of written notice of the dispute.
• Arbitration: If the dispute cannot be resolved informally, it shall be referred to and finally resolved by arbitration in accordance with the Arbitration and Conciliation Act, 1996 of India. The arbitration shall be conducted by a sole arbitrator mutually appointed by the parties. The seat of arbitration shall be in India, and the language of arbitration shall be English. The arbitrator's award shall be final and binding on both parties.
• Injunctive Relief: Notwithstanding the above, either party may seek injunctive or other equitable relief from a court of competent jurisdiction to prevent irreparable harm.

18. Force Majeure

Neither party shall be liable for any failure or delay in performing its obligations under these Terms due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, epidemics or pandemics, war, terrorism, riots, government actions or orders, power failures, internet or telecommunications failures, cyberattacks, or any other event that could not have been reasonably foreseen or prevented. The affected party shall promptly notify the other party and make reasonable efforts to mitigate the impact of such event.

19. General Provisions

• Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Company regarding the Platform and supersede all prior agreements, understandings, and communications, whether written or oral.
• Severability: If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
• Waiver: The failure of either party to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by the waiving party.
• Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
• Notices: All notices under these Terms shall be sent to the email address associated with your account (for notices to you) or to contact@webority.com (for notices to us).
• Language: These Terms are drafted in English. In the event of any conflict between the English version and any translation, the English version shall prevail.
